Introduction

This Privacy Notice explains how MAQIT S.A. (“MAQIT” or “we”/”us”) collects, uses, shares and otherwise processes your Personal Data in accordance with applicable data privacy laws and regulations, which include the General Data Protection Regulation 2016/679 (“GDPR”) which is applicable as of 25 May 2018.

Your privacy is important to us. The purpose of this Privacy Notice is to inform you about the information MAQIT may gather about you, how MAQIT may use that information, whether MAQIT discloses it to anyone, and the choices you have regarding our use of the information MAQIT collects.

Definitions

  • Country refers to: Luxembourg

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to MAQIT S.A., 2, Rue Drosbach, L-3372 Leudelange, Luxembourg.

  • Personal Data is any information that relates to an identified or identifiable individual.

  • Service refers to the Website.

  • Website refers to MAQIT, accessible from https://www.maqit.lu

Collecting and Using Your Personal Data

When using the term “Personal Data” in our Privacy Notice, we mean information that relates to you and allows us to identify you, either directly or in combination with other information that we may hold, as defined by the GDPR. From a general perspective, we process personal Data when necessary for us to perform our contractual obligations as the publisher of this Website (“Contractual Obligations”) and to enable us to be compliant with any legal or statutory obligations (“Legal Obligations”).

We may also process Personal Data when we consider that such processing can be based on our legitimate interests (“Legitimate Interest(s)”) and only when we assessed that your interests and fundamental rights do not override ours. For example, it may be in our Legitimate Interest to process certain Personal Data to continue to develop our business activities (quantitatively and qualitatively), to improve our business performance, etc.

Finally, please note that we may also need to process Data to respond to and to defend MAQIT against any legal claim that may arise.

The categories of data collected for the above purposes are the following:

  • Personal identification information: name and surname, postal and e-mail address, phone number

  • Content or messages you send to us or provide otherwise directly to us such as inquiries, questions, comments, answers to questions.

  • In the context of email marketing, certain additional data as further detailed in section “Email Marketing” below.

Usage Data

We use or may use your Personal Data for the following purposes (or as otherwise described at the point of collection) and on the following legal basis:

MAQIT uses your Personal Data only for the purposes for which it was collected, unless we consider that we may need to use it for another purpose which is compatible with a current and original purpose. Should such new purpose be unrelated to the existing purposes, we commit to notify you and to explain such new purpose together with the legal basis on which we intend to base that new purpose.

We may collect personal information through your use of our website, when you contact or request information from us, when you subscribe to our newsletter/mailing/trainings/webinars list and, in the context of direct email marketing, through certain other means as detailed in section “Email Marketing” below. When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device.

How we use information

We may use data we obtain for purposes relating to our website and services, including (a) providing the website and services to you, (b) raising queries with you, and responding to issues you may raise, whether relating to our services or otherwise, (c) processing job applications and (d) generating anonymized statistics and analysing anonymized statistical usage data of our web site. We may use the following third-party service providers named below to process and store your data:

    • Google Analytics Advertising Reporting Features

      Personal Data: Cookies; unique device identifiers for advertising (Google Advertiser ID or IDFA, for example); various types of Data as specified in the privacy policy of the service

    • Google Analytics/Google Search Console Demographics and Interests reports

      Personal Data: Cookies; unique device identifiers for advertising (Google Advertiser ID or IDFA, for example)

  • Displaying content from external platforms

    • Google Fonts

Disclosure and sharing of information

As a matter of policy, MAQIT does not sell, rent or provide in any form any of your information to third parties for any advertising or marketing purposes.

However, we may use external services such as Google Analytics for providing statistical and analytical services and process data on our behalf, without being allowed to share it with third parties.

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

 

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Email Marketing

As mentioned above, we may include you in our newsletter and/or marketing mailing list based on:

  • Your consent by subscribing to our newsletter or marketing mailing list through MAQIT’s website;

  • Our legitimate interest in the case of newsletter and/or marketing communications sent to you in the context of your professional activities. In this case and for this purpose only, data may be collected from you or through third parties, for example: when we interact with you in the context of our products and services, when you visit or contact us, or register to attend an event or appointment and, if and as appropriate and proportionate with your legitimate privacy expectations, through publicly available information.

Any email marketing messages we send are done so through an EMS, email marketing service provider. An EMS is a third-party service provider of software / applications that allows marketers to send out email marketing campaigns to a list of users.

We only collect certain data about you, as detailed above (personal identification data, content/messages you send to us). In addition, email marketing messages that we send may contain tracking beacons / tracked clickable links or similar server technologies in order to track recipients’ activity within email marketing messages. Tracking data may notably include: device data, IP address, forward/email open tracing, date/time/duration of recipient activity.

We will retain the data collected for email marketing purposes for a maximum of three (3) years from the date of the last communication with you.

Processing of your Personal Data outside of the European Union

As described above, your data may be processed by (i) Wix and (ii) Sendinblue, both of which host data outside of the European Union, including in the United States, which is not recognised by the European Commission of offering the same level of protection as the European Union. Please be ensured that we take all necessary steps in this respect to verify that your Personal Data receives an adequate level of protection, either by entering into data transfer agreements including standard data protection clauses adopted or approved by the European Commission or by otherwise ensuring appropriate safeguards and, where needed, by taking additional supplementary contractual, organisational or technical measures.

Your rights in relation to your Personal Data

Under the GDPR you have various rights as an individual which you can exercise under certain circumstances in relation to your Personal Data that we hold. These rights are to:
​Request access to your Personal Data (commonly known as a “data subject access request”) and request certain information in relation to its processing;

  • Request rectification of your Personal Data;

  • Request the erasure of your Personal Data;

  • Request the restriction of processing of your Personal Data;

  • Object to the processing of your Personal Data

Security of your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. Nonetheless we are committed to take appropriate technical and organisational measures to protect your Personal Data against unauthorised or unlawful processing and against accidental loss, disclosure, destruction or damage.

Your Personal Data is stored in the European Union. Electronic files that contain Personal Data are stored within a highly secured IT infrastructure.

Retention period

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

In the context of email marketing, we will retain your Personal Data as explained in section 5 (email marketing) above.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.
